Welcome to Casa de Artistas (accessible from https://www.casadeartistas.es/). These Terms and Conditions govern your use of our website and your participation in our workshops, gallery exhibitions, exhibition space rentals, and artist residency programs located in Cómpeta, Spain.
By accessing our website, booking a workshop, renting exhibition space, or submitting an application, you agree to accept these terms in full.
General Conditions
Casa de Artistas provides a creative space offering educational workshops, exhibition opportunities, and artist residencies. We
reserve the right to modify our services, website content, and these terms at any time without prior notice.
Workshop Bookings & Cancellations

Reservations: A workshop spot is only confirmed upon receipt of full payment or deposit as specified at checkout.

Participant Cancellations: Cancellations made up to 10 days before the workshop date are eligible for a full refund or credit. Cancellations made after this period may be non-refundable due to limited seating and material preparation.

Organizer Cancellations: If Casa de Artistas cancels a workshop due to unforeseen circumstances or low enrollment, you
will receive a 100% refund or the option to reschedule.
Gallery & Artwork Sales

Exhibitions: Visiting hours and event details for our gallery exhibitions are subject to change.

Art Purchases: All sales of physical artwork, prints, or exhibition pieces through our platform or gallery are final once completed, unless damaged prior to receipt. Title and risk of loss pass to the buyer upon delivery.
Exhibitions
Casa de Artistas hosts exhibitions in two formats: curated exhibitions, where works are selected by our curatorial team following an open call (such as our themed group exhibitions), which may involve a non-refundable participation fee once an artist accepts their selection; and exhibition space rental, where an artist pays a fixed fee to exhibit independently of the curatorial selection process. The provisions on delivery, promotional visuals, care of exhibited works, artwork sales, and image rights below apply to both formats. The specific reservation, payment, and cancellation provisions below apply to exhibition space rental.
Curated Exhibitions

Selection: Artists are selected by the Casa de Artistas curatorial team following an open call for entries. Submitting a proposal does not guarantee selection; results are communicated by the date stated in the call for entries.

Participation Fee: Casa de Artistas may charge a participation fee for a curated exhibition, as specified in the relevant call for entries. Once an artist has been selected by the jury and accepts their participation, payment of the fee is due and becomes non-refundable, including in the event of a later cancellation by the artist.
Exhibition Space Rental

Reservations: A rented space is only confirmed upon receipt of the full rental fee, due no later than 8 weeks before the exhibition start date. Until payment is received, Casa de Artistas may offer the space to another artist.

Artist Cancellations: Cancellations notified in writing at least 6 weeks before the exhibition start date are eligible for a full refund. Cancellations made after this period are non-refundable, due to promotional costs (advertising, website and print communication, signage) already committed by Casa de Artistas.

Organizer Cancellations: If Casa de Artistas cancels the exhibition for any reason, you will receive a 100% refund of the feealready paid, or the option to reschedule your participation to a later agreed date.

No Commission: The rental fee covers use of the space only. As with a curated exhibition, Casa de Artistas does not take any commission or percentage on artwork sold under this arrangement, regardless of any participation or rental fee charged — theartist keeps 100% of the sale price.

Rental Agreements: Artists renting exhibition space sign a separate, short Exhibition Space Rental Agreement confirming the artist's details, the fee, and the exhibition dates. Where such a signed agreement is in place, its specific terms prevail over thisgeneral section in case of any conflict.
Delivery, Care of Works & Image Rights — All Exhibitions

Delivery & Promotional Visuals: Artists provide photographs and a short description of their work as soon as their participation is confirmed (upon selection for a curated exhibition, or upon payment for a rented space), for use in promotional materials. Artworks themselves must be delivered to Casa de Artistas no later than 7 days before the exhibition start date.Early withdrawal of installed works requires 7 days' written notice and, for a rented space, does not entitle the artist to anyrefund, even partial.

Care of Exhibited Works: Casa de Artistas takes reasonable care of exhibited works for the duration of any exhibition and covers them under its general theft insurance policy, within the terms and limits of that policy (a copy or certificate isavailable on request). Beyond what the insurance covers, Casa de Artistas is only liable for loss, theft, or damage where fault in the care of the artwork is proven — a different, artwork-specific standard from the general "gross negligence" threshold described under Limitation of Liability below, which covers visitors' personal belongings rather than artworks entrusted to ourcare.

Image Rights: As with all exhibiting artists, an artist taking part in a curated exhibition or a rented space grants Casa de Artistas the same non-exclusive, royalty-free permission described under Intellectual Property Rights below to photograph and share their exhibited work for promotional purposes.
Artist Residencies

Applications: Submitting a residency application does not guarantee acceptance. Selection is at the sole discretion of the Casa
de Artistas curatorial team. -
Residency Agreements: Accepted resident artists will sign a separate Residency Agreement outlining house rules, studio
usage, accommodation, and stipend/fee arrangements.
Intellectual Property Rights

Site & Gallery Content: All text, website designs, photography, and brand media published on this platform remain the exclusive property of Casa de Artistas (or its licensors) and are protected by applicable copyright laws.

Artist Ownership & Permissions: Participating artists, residency candidates, and workshop guests retain 100% ownership copyright of their original creative works. By exhibiting, renting exhibition space, participating in a residency, or attending a workshop, artists grant Casa de Artistas a non-exclusive, royalty free permission to photograph, feature, and share images of their artwork across our website, promotional materials, and social channels strictly for educational, archival, and promotional purposes. Artists may opt out or modify this marketing permission at any time by contacting us in writing.
Code of Conduct & Studio Safety
Casa de Artistas is an inclusive, respectful creative community. We reserve the right to ask any workshop participant, resident, or gallery visitor to leave if their behavior is disruptive, unsafe, or abusive toward instructors, staff, or fellow guests.
Limitation of Liability
Casa de Artistas is not responsible for personal injuries, lost personal items, or accidental damage to personal belongings during your visit to our facilities, except in cases of direct gross negligence on our part. Artworks entrusted to Casa de Artistas as part of a curated exhibition or an Exhibition Space Rental Agreement are covered separately, under the specific standard described in the Exhibitions section above.
Applicable Law & Jurisdiction
These terms are governed by and construed in accordance with the laws of Spain. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Málaga, Spain.
